Below you will find the general terms of use for the parking spaces and related services.

1. General rules applicable to the use of the Parking area
1.1 Definitions
“BITM” refers to Brussels International Trade Mart Ltd. & Co bv, with registered office at Atomiumsquare 1, box 211, 1020 Brussels, VAT BE 413.030.255 RPM Brussels.
The “User” is any person who stops, parks, or drives a Vehicle in the Parking areas, in any capacity and for any duration.
The “Vehicle” refers to any wheeled vehicle, motorized or not, including but not limited to all car types such as vans, trucks, motorcycles, scooters, or bicycles.
The “Parkings” refer to all parking spaces and additional areas, covered or open-air, operated or made available by BITM on its site, located within the perimeter formed by Atomiumlaan, Eeuwfeestlaan, Miramar/Esplanadelaan, and Madridlaan, 1020 Brussels.
1.2 Scope of the Parking Agreement
Unless subscribing to or using an additional service as described in sections 2, 3, and 4 below, BITM’s service is limited to providing an unspecified parking space within its Parkings. BITM does not act as a custodian and accepts no obligation to monitor or supervise the User’s Vehicle. BITM is under no obligation to ensure continuous access to the Parkings and reserves the right to carry out or have works carried out at any time and without prior notice. These works do not entitle the User to any compensation.
BITM may privatize all or parts of the Parkings or grant exclusive use rights to third parties at any time and without notice, again without any right to compensation for the User. Users may not claim ongoing access to the Parkings in terms of time, form, or type of services. BITM may, at any time and without notice, define or modify access conditions, including tariffs and hours for entry and exit.
The Parking characteristics, including rates, opening hours, and maximum vehicle height, are displayed at the entrance and must always be complied with by Users.
1.3 Duration of the Parking Agreement
The agreement starts when the User enters the Parking by passing the entry barriers and ends when they exit through the exit barriers.
By entering the Parking, the User accepts these terms unconditionally. No Vehicle may remain parked for more than ten consecutive days without prior written consent from BITM. Starting on the 11th day, an additional fee of €10/day (minimum €85) is due. This is payable without prior notice and without prejudice to other measures, including further compensation and interest.
If BITM does not know the User’s identity and cannot contact them, it reserves the right to remove the Vehicle from the Parkings at the User's risk and expense, including any damage to the Vehicle. This may also occur before the tenth day in case of obstructive or dangerous parking.
1.4 Price
Unless the User holds an annual acces with parking subscription (see section 2), all Users must pay the parking fee (the “Price”) as stated at the entrance or within the Parkings. Prices may change at any time without notice by simply updating the posted tariffs. Payment is due before leaving the Parkings.
Users entering by (electric or non-electric) bicycle and using the designated bike racks are not required to pay a parking fee.
If the User leaves the Parking within 15 minutes, the Price will be forfeited.
A validated (i.e. paid) parking ticket is valid for 24h. A lost parking ticket (too) also costs the User 10€.
1.5 Use of the Parkings
All Vehicles must comply with the same conditions as those on public roads (license plate, insurance, etc.). The Highway Code applies. The speed limit is 10 km/h.
Users must avoid causing any inconvenience to local residents, buildings, monuments, or other Parking users. In the event of an accident or breakdown, the User must move the Vehicle to avoid blocking passage. Users must comply with all signage and ground markings.
Vehicles must be parked in designated spaces corresponding to their type. Spaces reserved for persons with reduced mobility, bicycles, mopeds, motorcycles, or electric vehicles must be respected and used only by the intended Vehicle types.
Access is prohibited for trailers, oversized vehicles, or those with snow chains unless BITM has given prior written consent. Any damage caused by such vehicles will be charged to the User.
No items (e.g. tires, crates) may be left in the Parking. Without written consent from BITM, washing, maintenance, or repair of Vehicles in the Parkings is prohibited. Offering goods or Vehicles for sale or rent is also forbidden.
Explosive, flammable, or hazardous materials may not be stored in the Parkings. No person or animal may remain in a parked Vehicle, and no valuables visible from outside may be left inside. Vehicles must be locked with all windows closed and all openings secured.
1.6 Removal or immobilization of Vehicles
The User authorizes BITM to move or have their Vehicle moved, inside or outside the Parkings, at the User’s risk and expense, without liability for any damage, if:
the Vehicle is not in a space appropriate for its type,
it is in a reserved or restricted space (e.g. for disabled users or electric Vehicles),
it obstructs access,
it is left for over 30 consecutive days without written permission,
or for safety or operational reasons.
In such cases, the Vehicle may also be immobilized with clamps.
The User will be charged a flat fee of €250 (excl. VAT) plus towing and administrative costs for each such action.
1.7 Liability
BITM declines all liability, in any form or for any reason, for direct or indirect damage to the Vehicle, or any damage suffered by the User resulting from accidents, theft, or intentional or unintentional damage by third parties in or related to the Parkings.
1.8 Complaints
All complaints or requests must be submitted in writing to info@trademart.be or by registered mail to Atomiumsquare 1, box 211, 1020 Brussels.
1.9 Amendments
BITM may modify these General Terms at any time. Changes will take effect one month after written notice or posting within the Parkings.
1.10 Jurisdiction
These terms and related agreements are governed by Belgian law. All disputes fall under the exclusive jurisdiction of the courts of Brussels (district of Laken).
2. Rules for "Annual Access with Parking Subscription"
2.1 Scope
These terms apply to Users holding an annual access with parking subscription ("Annual Access with Parking Subscription"), which can be subscribed to at BITM. They supplement, without deviation, the terms from sections 1, and where applicable, 3 and 4, and the specific conditions in the individual agreement.
2.2 Access terms
Holders may use the Parkings as defined in section 1, without paying a fee for each use, as it is included in the subscription. They must use the MyTrademart mobile app to exit the Parkings and benefit from the subscription services.
No continuity of access or designated space is guaranteed (see section 1.2).
2.3 Payment
Payment is made under the terms of the individual agreement. BITM may modify future rates at any time without prior notice, though this does not affect already subscribed and paid Annual Access passes, except upon renewal.
2.4 Responsibility
BITM reserves the right to cancel or deactivate any expired or fraudulently used Annual Access with Parking Subscription.
3. Rules for use of electric charging stations
3.1 Scope
These terms apply to all Users who, regularly or occasionally, with or without an Annual Access Subscription, use the electric charging stations on the Parkings. These terms supplement sections 1, and where applicable, 2 and 4.
3.2 Prerequisites
BITM has installed charging stations. Users must enter into a separate agreement with a charging operator, and possess a valid subscription, account, and access cards/badges. The operator’s contact information is displayed on the chargers.
3.3 Terms of use
Only vehicles that are fully or partially electrically powered and can be charged may be parked or left stationary in spaces designated for electric charging. These spaces may only be used during the actual charging time required. Once charging is complete, the vehicle must be moved immediately.
Unless explicitly agreed otherwise with BITM, the charging spaces for electric vehicles are not reserved for any specific User. Any mechanism or system used to reserve these spots is prohibited unless prior approval has been obtained from BITM.
Before starting to charge, the User must verify that their Vehicle is compatible with the charging station and must always follow the instructions and recommendations related to the use of the charging station and the charging of their Vehicle.
3.4 Liability
Users use the charging stations entirely at their own responsibility and risk. They are solely liable for the proper use of the charging stations.
BITM declines all liability, under any title or for any reason, for any direct or indirect damage of any kind caused to the Vehicle or for any damages suffered by the User as a result of the use of the charging stations in the Parkings.
Furthermore, the User who uses the charging stations shall be fully liable—and hereby fully releases and indemnifies BITM—for any claim made by the charging station operator or by third parties related to the User’s use of the charging stations.
The User undertakes to leave the charging station in full working order. BITM cannot be held liable for any damage or loss, whether direct or indirect, resulting from the temporary or permanent unavailability of the charging stations—regardless of whether this results from changes in access conditions or technical specifications by the operator, power outages, technical failures, shutdowns initiated by the operator, inaccessibility of the designated spots, or any other cause.
If the designated charging spaces are unlawfully occupied by Vehicles that do not have the right to be there, BITM alone has the right to decide whether these Vehicles need to be moved. BITM cannot be held liable in any way for failing to remove or for delays in removing such Vehicles.
3.5 Price / Cost of use
The financial and billing conditions related to the use of the charging stations are determined exclusively in the agreement between the User and the operator of the charging stations.
The User understands and accepts that these financial or billing terms may change, and that BITM cannot be held liable in any way for such changes—even if they result from fluctuations in supply costs or electricity conversion costs for BITM, which are neither fixed nor guaranteed.
The fact that the User uses the charging stations and pays the applicable fee to the operator does not in any way exempt the User from complying with these general terms and conditions.
4. Rules applicable to reserved Parking spaces
These general terms and conditions also apply—without prejudice to their content—to any User who has entered into an agreement (rental, lease, occupancy, etc.) to reserve one or more specific parking spaces on the premises.
In case of a conflict between a provision in these general terms and the specific provisions of such an agreement, the latter shall prevail.
5. Rules applicable to personal data
Personal data concerning the User will be stored in BITM’s database. These data may be used for the following purposes: invoicing, customer management, management of the commercial relationship with the User, commercial prospecting, offering of additional services, and general use of the Parkings (including safety purposes).
In accordance with the law on the protection of personal data, the User has the right to access and correct their personal data. The User may exercise this right by sending a signed written request together with a double-sided copy of their identity card, either via email to info@trademart.be or by post to Atomiumsquare 1, P.O. Box 211, 1020 Brussels.
